Equitable Property Division

Georgia divides marital property “equitably.” Equitable distribution does not always mean equal division. Courts define marital property as property acquired during the marriage, with a few exceptions. Separate property should remain your property. Deciding what property is marital can sometimes involve difficult analysis. At The Silver Law Firm, we help our clients protect their interests in the division of property including:

  • The marital home
  • Second homes or vacation homes
  • Pensions or 401k plans
  • Savings
  • Debts
  • Cars and other personal property

In the absence of an agreement between you and your spouse, the court will decide which property is marital property. Because we know that each client’s situation is unique, we tailor our approach to meet your needs. When a settlement with your spouse would be beneficial, we work diligently to protect your interests in negotiations and mediations. If litigation is required, we never hesitate to fight for you forcefully in the courtroom.
